Privacy, terms of service, refunds and class recordings

French Immersion College is a live online French-language school operated by McDonald Insight International in Nigeria. In this policy, “we”, “us” and “our” refer to McDonald Insight International trading as French Immersion College.
This policy explains how we collect, use, disclose, retain and protect personal data through our website, placement test, enrolment and payment process, live classes, learning platform, booking tools and support channels. It also explains our recording arrangements and the use of anonymised learning material to develop future offerings.
Depending on the activity, we rely on consent, performance of a contract, compliance with legal obligations, protection of vital interests where applicable, or our legitimate interests where those interests do not override the individual’s rights.
We may use service providers for website hosting, email, learning management, ecommerce, payments, booking, video meetings, protected video storage, analytics, backups and customer support. These providers may include the final providers selected for WordPress hosting, LearnDash, WooCommerce, Paystack or Flutterwave, Microsoft Teams or another meeting service, Amelia or another booking service, and protected video hosting.
Some providers may process data outside Nigeria. Where personal data is transferred internationally, we will use a lawful transfer mechanism and reasonable contractual, organisational and security safeguards appropriate to the transfer.
We do not sell personal data. We may disclose information where required by law, to protect legal rights or safety, in connection with a legitimate business reorganisation, or with the individual’s direction or consent.
We retain information only for as long as reasonably necessary for the purpose for which it was collected and for applicable legal, accounting, tax, dispute and security requirements. Our general approach is:
These periods may be shortened or extended where law, a dispute, security needs or technical backup cycles reasonably require it.
We use reasonable administrative, technical and organisational safeguards, including role-based access, password controls, limited recording access, backups and service-provider controls. No online system is completely secure, and learners must protect their credentials and notify us promptly of suspected unauthorised access.
Subject to applicable law, an individual may ask to be informed about processing; access personal data; correct inaccurate data; request deletion or restriction; object to certain processing; withdraw consent where processing relies on consent; request data portability where applicable; and complain to the Nigeria Data Protection Commission.
Requests may be submitted through the Contact Us page. We may need to verify identity before acting. Withdrawing consent does not invalidate processing that was lawful before withdrawal and may affect our ability to provide an optional service.
The website may use essential cookies for login, security, shopping and preferences, and optional analytics or marketing cookies where enabled. A cookie notice will explain available choices. Links to government, examination, social-media or other third-party websites are governed by those third parties’ own policies.
Release 1 is intended for adult learners aged 18 and above. We do not knowingly enrol a child through this adult programme. Any future children’s or teenagers’ programme will require separate enrolment, consent and safeguarding arrangements.
Privacy questions or requests may be sent through the Contact Us page and marked “Privacy”. We may update this policy when our services, providers or legal duties change. The current version and effective date will be published on the website.

These terms apply to use of the website and purchase or use of French Immersion College services. Before completing account registration or enrolment and before payment, the learner must actively select an unticked checkbox confirming that the learner has read and agrees to our combined Terms and Student Policies, including the privacy information, service terms, refund arrangements and live-class recording rules in this document. The learner also confirms that the learner is at least 18 years old and has provided accurate information. One clearly labelled link to the complete document must appear beside the checkbox before acceptance. Opening the link or continuing to browse alone does not constitute acceptance.
Agreement to the Live-Class Recording Policy includes notice that classes are recorded, the limits on portal access and reuse, and the use of anonymised material for our future LLM-based learning offerings. Identifiable learner contributions will not be used for LLM training.
Updated to require one mandatory checkbox and one link to the combined document, at registration or enrolment and checkout.
We provide French-language education and related learning support. Public information about Canadian immigration, work or study opportunities is general educational information based on public sources. We do not assess immigration eligibility or provide legal or immigration advice. Learners should use official sources and a properly authorised adviser where individual advice is required.
Enrolment does not guarantee a CEFR or NCLC level, a TEF or TCF result, permanent residence, a visa or permit, admission, scholarship, employment or any other external decision. The separate examination-fee guarantee applies only where its published conditions are satisfied.
Complete beginners normally begin at A1.1. A learner with previous French may complete a placement test. Placement results are indicative and may be reviewed or overridden by the academic coordinator using additional evidence or a short conversation.
A stream opens only when operational requirements are met. We may change a proposed start date, combine or divide streams, or offer an alternative timetable where reasonably necessary. If we cannot offer a reasonable alternative for a paid but unstarted course, the learner may choose a transfer, credit or refund for the affected undelivered course.
A learner may purchase an individual sublevel or an available longer pathway. A longer-pathway purchase establishes entitlement to its included sublevels; the learner does not repurchase those sublevels. Access is released progressively.
Only the current sublevel is accessible. Upcoming included sublevels may appear locked. After the current sublevel and required assessment are completed, the coordinator reviews progression and assigns the learner to an available stream for the next sublevel. Release 1 does not promise an automatic progression decision or immediate access to every sublevel.
The price displayed at checkout for the selected course or pathway is the applicable tuition price, subject to any clearly stated promotion. Registration fees, payment schedules and transaction terms will be shown before payment. A promotional fee or discount may have eligibility or time limits disclosed with the offer.
A payment is complete only when confirmed by the payment provider. The learner is responsible for accurate payment information and any bank or currency-conversion charges imposed by the learner’s provider.
Learners are expected to attend punctually, participate respectfully, complete required work and follow assessment and academic-integrity instructions. Attendance and participation are recorded separately. Missed classes do not automatically create a right to a private replacement class, timetable change or extension.
Progression may depend on completion of the current sublevel, required assessments and coordinator review. A learner may request correction of an inaccurate attendance, participation or grade record.
Learners must not harass others, disrupt classes, impersonate another person, share restricted links, misuse recordings or materials, attempt unauthorised access, cheat, or use the service unlawfully. We may issue a warning, restrict access, move a learner, suspend participation or terminate enrolment where reasonably proportionate. Serious misconduct may result in immediate suspension while the matter is reviewed.
Course plans, slides, assignments, quizzes, recordings, branding and other materials are owned by or licensed to McDonald Insight International. Class recordings made by or for us remain our property, subject to applicable third-party rights. Enrolment gives the learner a personal, limited, non-transferable right to view or listen to recordings and use materials for the learner’s own study during the permitted access period. Any other use requires our prior written permission. Our ownership does not remove a learner’s privacy rights or transfer ownership of the learner’s pre-existing work.
Learners may not sell, publish, upload, copy in bulk, rebroadcast, screen-record, distribute or give another person access to restricted materials, meeting links, recordings or accounts without written permission.
The learner is responsible for a suitable device, internet connection and compatible software. We will take reasonable steps to deliver the service, but uninterrupted access cannot be guaranteed. Maintenance, provider outages, security incidents or events beyond reasonable control may require rescheduling or temporary alternative arrangements.
Nothing in these terms excludes or limits liability or consumer rights that cannot lawfully be excluded. Subject to that rule, we are not responsible for indirect or consequential loss, external immigration or examination decisions, or a learner’s equipment, connectivity or third-party services outside our reasonable control.
A learner should first contact us through the Contact Us page with relevant details so we can investigate and respond. These terms are governed by the laws of the Federal Republic of Nigeria. This does not prevent a consumer from using a remedy or regulator available under applicable law, including the Federal Competition and Consumer Protection Commission or the Nigeria Data Protection Commission.

We aim to apply refunds and cancellations fairly, transparently and consistently. This policy does not remove any right or remedy that cannot lawfully be excluded. Any restriction connected with a promotion will be disclosed in writing before purchase.
If we cancel a paid course or cannot open the selected stream and cannot provide a reasonable alternative accepted by the learner, the learner may choose:
We are not responsible for unrelated costs, such as data, equipment, travel or commitments made to third parties, except where mandatory law requires otherwise.
A learner may request cancellation before the applicable course or sublevel begins. The refund will be the tuition paid for that unstarted course or sublevel, less any reasonable and disclosed administrative charge and any non-recoverable third-party transaction charge actually incurred. If a registration fee is charged and described as non-refundable before purchase, it will not be refunded except where required by law or where we cancel the service.
After teaching begins, a refund is calculated fairly using the undelivered portion of the purchased service, less the value of teaching, access, materials or benefits already provided and any reasonable administrative or non-recoverable transaction charge. The calculation will be explained to the learner. Missed classes are treated as delivered where the class took place and access was available.
A learner should submit the request promptly. Delay may increase the portion of the service already delivered and reduce the available refund.
For an A1-A2, A1-B1 or A1-B2 purchase, unopened included sublevels remain part of the original entitlement. If the learner cancels, any refund for future undelivered sublevels may be calculated by deducting:
A cancellation or refund that ends the complete A1-B2 entitlement also ends eligibility for the examination-fee guarantee unless we confirm otherwise in writing.
A learner may request a transfer or deferral. Approval depends on timing, space, academic level and availability. We will try to accommodate a first reasonable request, but cannot guarantee a preferred teacher, timetable or immediate next stream. Any applicable charge will be disclosed before the learner accepts the change.
Submit the request through the Contact Us page using the registered email address. Include the learner’s name, order number, course or pathway, requested outcome and reason. We may request information needed to verify and calculate the request. Approved refunds are returned through the original method where practical or another verified method agreed with the learner.
We will acknowledge a complete request and communicate the decision and calculation within a reasonable period, normally 15 business days. Payment-provider timelines may affect when funds appear. If the learner disagrees, the learner may request an internal review and provide supporting information without losing any statutory complaint right.

Live classes are recorded to support lesson review, learning continuity and quality assurance. A recording may also be used to investigate a reported incident or meet a documented legal requirement. Only anonymised material may be used for the future LLM-development purpose in section 7 below. Technical or privacy issues may prevent a recording from being made available for a particular class.
Learners are told before enrolment that classes are recorded and receive a meeting notice or announcement when recording begins. A recording may capture a learner’s display name, voice, image, chat messages, screen sharing and other contributions. Agreement to the recording policy does not authorise the use of identifiable learner contributions for LLM training.
Where camera use is not required for a specific assessment or activity, a learner may keep the camera off. Because speaking and participation are part of live language learning, a learner’s voice may still be captured. A learner with a specific concern should contact the coordinator before class so that a reasonable option can be considered where practical.
Recordings are made available to authorised learners in the relevant stream only within their student portal, for personal lesson review. Recordings may be accessed during the sublevel or stream and for a maximum of 90 calendar days after its last live class. Access ends at that deadline and is not extended by a late upload, missed class or later viewing. Authorised teachers, coordinators and administrators may access recordings for the purposes described in this policy.
Recordings remain the property of McDonald Insight International. Except for the permitted personal study within the portal, learners must not download, screen-record, copy, publish, sell, forward, rebroadcast, share or otherwise use recordings or access links without our prior written permission. This includes uploading a recording or transcript to an external AI service. Access may be suspended where misuse is suspected. We may use expiring links, access controls and provider logs to protect recordings.
The access period now follows the stream sheets: at most 90 calendar days after the last live class of the enrolled sublevel or stream.
A learner may not independently audio-record, video-record, photograph, screen-record or livestream a class, teacher or another learner without prior written permission. This protects privacy, intellectual property and a safe learning environment.
A teacher, coordinator or administrator may check a recording before publication. A recording may be withheld, edited where practical, restricted or removed because of privacy, safeguarding, quality, legal or technical concerns.
The 90-day deadline limits learner access; it does not transfer ownership of the recording. After the access period, identifiable recordings are deleted unless restricted retention is required for a documented legal, complaint, safeguarding or security reason. They will not be retained as identifiable LLM-training material. Separately prepared anonymised material may be retained for the purpose described in section 7. Backup deletion may follow the provider’s normal cycle.
A learner may report unauthorised sharing, request correction of identifying information or raise a privacy concern through the Contact Us page. Removal or editing of a contribution cannot always be guaranteed where it is technically impractical or where retention is lawfully required, but we will review the request and take reasonable action.
We reserve the right to use anonymised class recordings, extracts or transcripts to develop, train and evaluate large language models (LLMs) and related tools that aid our future French-learning offerings. This includes developing explanations, practice activities, courses, programs, learning platforms and learning support. Identifiable learner contributions will not be used for this purpose.
Before any material is used for this purpose, we will remove or transform names, contact details, account identifiers, faces, identifiable voices, chat identifiers and personal details that could identify a learner. Removing a name alone is not sufficient. We will use material only when a learner cannot reasonably be identified from it, including by combining it with other reasonably available information. If that standard cannot be met, the material will be excluded. Raw identifiable recordings will not be uploaded to an LLM-training service.
Any service provider handling recordings to prepare anonymised material must do so under our instructions and appropriate privacy and security safeguards. Providers may not use identifiable learner contributions for their own model training. Only the anonymised output may be supplied for the LLM-development purpose. Intellectual-property rights, confidentiality and applicable law continue to apply.
Learners may contact us through the Contact Us page if they believe material used for this purpose identifies them. We will investigate and restrict or remove affected material as appropriate. Learners retain their applicable rights over personal data; agreement to these terms does not waive those rights.
This follows the clarification that identifiable learner contributions will not be used. Anonymisation must prevent reasonable identification; merely removing names is insufficient.

I confirm that I am at least 18 years old and have read and agree to the Terms and Student Policies. I understand that classes are recorded, that recordings are available within my portal for up to 90 days after the last class of my sublevel or stream, and that other use requires written permission. I agree that anonymised material may be used to train LLMs supporting future learning offerings. Identifiable learner contributions will not be used.
Keep all sections in one combined policy document or webpage. Show one checkbox, unticked by default, beside one clearly labelled “Terms and Student Policies” link that opens the complete document without losing entered registration information. Require active acceptance before registration or enrolment can be submitted and before payment can proceed. An existing account must also accept the applicable policy version at checkout if that version has not already been accepted. Clicking the link alone must not mark the checkbox as accepted. Do not create a separate LLM policy or LLM-consent checkbox.
If acceptance is missing, show: “Please read and agree to the Terms and Student Policies to continue.” A missing checkbox must prevent completion, with the same requirement applied on mobile and desktop.
Record the learner or account reference, date and time, policy version, exact checkbox wording and whether acceptance occurred at registration or checkout. Keep the acceptance record with the learner or order record. Provide the accepted combined document or its link in the confirmation email and student portal. Keep optional marketing choices separate from this required agreement.
If any clause here affects your decision, message us and we will explain it in plain language.
